Terms of Service

1. Agreement and eligibility

By creating a booking, checking the agreement box, or using the Services, you agree to these Terms of Service and acknowledge our Privacy Policy. You must be at least 18 years old, physically located in the United States while using the Services, and authorized to submit the documents you upload. You must provide accurate information and use your own identity and contact information. If you use NotaryStack on behalf of an organization, you represent that you have authority to act for it; each individual signer must separately participate in and consent to their own notarization.

2. Online notarization

Notary Tech offers access to remote online notarization performed by a Florida online notary public. The online notary must be physically located in Florida when performing the act. A notary may decline or stop a session when required by law or professional judgment, including if the notary cannot confirm identity, determine willingness or awareness, complete a required step, or lawfully notarize the requested document. Payment and booking do not guarantee that a particular document can be notarized or will be accepted by its intended recipient. You are responsible for checking the recipient’s requirements and for the document’s content, completeness, and suitability. We do not provide legal advice.

If you are physically outside Florida when the notarial act is performed, you agree that you desire the act to be performed by a Florida notary public under the general law of Florida. The notary will confirm that desire with you verbally during the recorded session. Your acceptance of these Terms does not replace the notary’s confirmation.

You agree to participate in the live audio-video session and to its recording, as required for Florida remote online notarization. Do not record or distribute another participant’s image or voice without authorization.

3. Booking and prices

Current base prices are $19 for on-demand service, $15 for flexible scheduling, and $12 for next-day scheduling. The applicable booking page shows the service and total charge before payment. One notarization is included in the base price. Each additional notarization requested and completed during the same session costs $8, as disclosed at checkout. By requesting an additional notarization during the session, you agree to the $8 charge to the payment method used for the booking. We will disclose the charge before performing the additional act. We charge for additional notarizations actually performed, not for unused stamps or merely proposed acts. Applicable taxes or other charges, if any, are displayed before you authorize payment. We may change prices for future bookings without changing a booking already purchased.

4. Attendance, cancellation, and refunds

Bookings are nonrefundable except as stated in this section or required by law. For on-demand bookings, the 15-minute response period begins when you have completed the required preparation steps and entered the waiting room ready for the notary. If no notary joins within 15 minutes, you may request cancellation and a full refund or continue waiting. If you continue waiting, you may request cancellation and a full refund until a notary joins. Once a notary joins, the booking is nonrefundable except as required by law.

Flexible and next-day appointments are scheduled in advance and are nonrefundable after booking, including if you cancel, miss the appointment, or arrive unprepared. You may request a change before the appointment, subject to available times; a change is effective only when confirmed. If we cancel a scheduled appointment or cannot provide a notary at the scheduled time, we will offer a new appointment or a full refund. We will not charge for an additional notarization that was not performed. Approved refunds return to the original payment method, with posting time determined by the payment provider or bank. Nothing here limits rights that cannot legally be waived.

5. Documents and electronic delivery

You retain ownership of your documents. You grant us the limited permission needed to upload, display, process, sign, notarize, store, deliver, and retain them as described in these Terms and the Privacy Policy. You must have permission to upload any other person’s information contained in a document. We may reject files that are unsafe, illegible, incompatible, unlawful, or inappropriate for the requested act. After a completed session, we deliver the completed PDF electronically to the email address associated with the booking. You are responsible for keeping your email address accurate and downloading your copy.

6. Service communications and text messages

We may send service-related emails about your booking, session, payment, and completed document. If you separately opt in to SMS after checkout or through another dedicated enrollment step, NotaryStack may send non-promotional text messages about session invitations, verification codes, booking confirmations, reminders, status updates, and support. Message frequency varies. Message and data rates may apply. Reply STOP to stop texts and HELP for help, or contact us at 561-576-0919. SMS consent is optional and is not a condition of purchase. Accepting these Terms does not enroll you in SMS. If you do not separately opt in or later opt out, we will use available non-SMS methods, such as email, for essential service information. We do not send promotional texts under this program. Carriers are not liable for delayed or undelivered messages. See the Privacy Policy for how we handle mobile information.

7. Acceptable use and availability

Do not impersonate another person, upload unlawful material, interfere with security or other users, or attempt to access records that are not yours. You need a compatible device, reliable internet connection, working camera and microphone, and access to the email account used for your booking. Internet and third-party service interruptions can occur. We may suspend access to prevent misuse or protect the Services, while honoring applicable recordkeeping and refund obligations.

8. Privacy and records

Our Privacy Policy explains the information we collect, how we use and share it, and our retention schedule. Florida law requires electronic notary journal entries and unedited session recordings to be retained for at least 10 years. A deletion request cannot override legally required retention or an applicable legal hold.

9. Disputes and governing law

Florida law governs these Terms, except where another law must apply. Any lawsuit arising from the Services or these Terms must be brought in a state or federal court with jurisdiction in Palm Beach County, Florida, subject to any non-waivable consumer rights. Nothing here prevents you from contacting a regulator or exercising a statutory right.

10. Changes and contact

We may update these Terms prospectively. The version presented when you accept a booking governs that booking unless applicable law requires otherwise.
